Should the bank refund me the bank charges

Thanks a lot for your emails containing the information on MF. I read the same with good interest and apply accordingly. I have a problem. I had applied for the the units of L&T Infrastructure Fund, but the check was not honoured by the Bank as there was a mistake in the date tag. But there was sufficient credit in the account. Can the Bank charge for the mistake? The same bank charged for their own mistake - a cheque on the bank issued to another account in an another bank was dis honoured and a penalty was deducted along with the GST charge. I had to raise some loan and credit the same in the second bank - as I had issued some cheques from the second Bank - just to see that the cheques are not dishonoured. Is the first Bank liable to pay me the charges to be levied by he second bank and also the interest charges for the loan and for their mistake and what are the charges in this respect. Please guide?

With regards to the first point, since the mistake was on your part, the bank rightly levied a bank charge on account of 'cheque dishonour' even though the reason is not 'insufficient fund' but a mere error in the date. Irrespective of the reason, these days, most of the banks debit a bank charge (the bank charges depend on the reason and vary from bank to bank) on account of 'cheque dishonour'.

With regards to the second point, though we could not understand it fully, excepting that there was some issues when your bank presented your cheque to the wrong account and debited you with 'bank charges' even though there was no fault from your side. Please note that in this case, you will have to pursue the case aggressively with your bank for reversal of bank charges and/ or the claim for interest loss etc.

However, to get a claim amount or reversal of debit from your banker is not an easy task unless you can prove them wrong and pursue it aggressively in writing. If you think, your case is solid, you may even pursue with the higher authorities of your bank if your branch is no co-operating on this.

Please make a strong case against your bank with proof of documents and transaction details etc. before you pursue the case strongly with your bank branch or with the higher authorities.
